Why are we presenting this topic? To instruct the business, insurance, claims and industrial community about the potential impact of recent development in Florida Workers Compensation Law as it applies to attorney’s fees, and the viability of the statute, generally speaking, from a constitutional standpoint. That sounded very stuffy so here's a bit more information...First we'll do a some review and chat about the history of Workers Compensation and Workers' Comp in Florida over the years. Then we'll move on to the Current State of the Law – what you get in Workers' Comp v. what you get in tort – do plaintiff attorney’s really want to go back to tort? We should also try to get a good idea of how many injured workers we're talking about, and how many are litigated. We'll talk about newer issues such as Westphal and the Grand Bargain; Miles v. City of Edgewater Policy Department – freedom to contract with an attorney. And finally, Castellanos - have the flood gates opened? What is the legislative response?
